Submission summary

This study, which fits in the field of research, Law and Finance, consists in studying both ex post and ex ante efficiency of the two French legal procedures to resolve consumers' financial distress: the debt refinancing plan designed by the 'commission de surendettement' and the new legal procedure: the liquidation of assets. In the first case, we expect to describe the various factors that lead some consumers to go bankrupt in order to evaluate the risk of consumers' credit. We will either explain the factors governing the judges' decisions to accept/reject a liquidation procedure for consumers, the level of debt release in the liquidation process and how commissions de surendettement decide to enforce a debt refinancing plan. In the second case, we will model the expected effects of this new debtor friendly system on the incentives of banks and consumers (credit rationing, secured credit).
